FishAtlas Terms of Use

Effective date: October 17, 2026

These Terms of Use (“Terms”) are a binding agreement between you and Streams to Summits LLC, a Montana limited liability company (“Streams to Summits,” “Company,” “we,” “us,” or “our”), governing your access to and use of FishAtlas, including the FishAtlas mobile application, websites, beta versions, subscriptions, data, content, and related services (collectively, the “Service”). FishAtlas is owned and operated by Streams to Summits LLC.

By creating an account, tapping an acceptance button, purchasing or starting a subscription, or otherwise using the Service after these Terms are presented to you, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be legally capable of entering into these Terms. If you use FishAtlas on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for safeguarding your credentials and for activity conducted through your account. Information you provide must be accurate and kept reasonably current.

2. License to use FishAtlas

Subject to these Terms and your compliance with them, Streams to Summits grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use FishAtlas on Apple-branded devices you own or control as permitted by the applicable App Store rules, solely for lawful personal or internal use.

You may not copy, sell, rent, sublicense, distribute, reverse engineer, circumvent security or access controls, scrape the Service at scale, interfere with operation of the Service, use the Service to create a competing dataset or product, or use FishAtlas in violation of law or another person’s rights.

3. Fishing information is informational, not a guarantee

FishAtlas provides recreational fishing information, planning tools, maps, forecasts, environmental data, species information, recommendations, and educational content. FishAtlas does not guarantee fishing success, fish presence, water conditions, safe access, legal access, navigability, weather, regulatory status, or the accuracy or completeness of any recommendation.

Terms such as “Optimal,” condition colors, scores, rankings, recommended waters, or similar labels are decision-support information only. They are not a representation that a waterbody, road, trail, shoreline, boat route, or wading location is safe.

4. Maps, access, and public lands

Property boundaries, public-land layers, access points, boat launches, roads, trails, easements, parking, and related map information can be incomplete, delayed, generalized, or inaccurate. A FishAtlas map, pin, polygon, or recommendation does not grant permission to enter land or water. You are solely responsible for confirming ownership, public access, easements, closures, posted restrictions, parking rules, and other access requirements before entering an area.

5. Water conditions, gauges, weather, and forecasts

FishAtlas may display information derived from USGS, NOAA, weather providers, state agencies, and other sources. Gauge data, streamflow, temperature, turbidity, weather, tide, forecast, and similar data may be delayed, provisional, incomplete, unavailable, or affected by equipment and network failures. Conditions can change quickly. FishAtlas is not an emergency warning service and is not a substitute for official warnings, local knowledge, or on-site judgment.

6. Bathymetry and navigation

Bathymetry, depth contours, depth labels, and similar information are provided for fishing and planning context only. FishAtlas is not a nautical chart, hydrographic survey, navigation system, or certified boating product. Depth data may be dated or incomplete and may not reflect current water levels, submerged hazards, changing channels, sedimentation, or other conditions. Never rely on FishAtlas alone for navigation or safe clearance.

7. Species, fish, fly, bug, and lure information

Identification tools, species lists, fish records, hatch information, fly recommendations, bug information, and lure information are educational and may be uncertain or incomplete. FishAtlas identification is not a legal determination of species, protected status, harvest eligibility, possession limits, or regulations. You are responsible for knowing and following applicable fishing regulations.

8. Offline maps

Offline features may contain cached or downloaded information that becomes outdated after download. Offline use can prevent FishAtlas from receiving current closures, forecasts, flows, regulations, map changes, or other updates. Users must obtain current information when safety, legality, or access depends on it.

9. User content and photos

If the Service allows you to submit photos, feedback, reports, notes, or other content, you retain ownership of content you own. You grant Streams to Summits a non-exclusive, worldwide, royalty-free license to host, reproduce, process, display, and use submitted content as reasonably necessary to provide, secure, support, and improve the feature for which it was submitted. You represent that you have the rights necessary to submit the content.

10. FishAtlas Pro subscriptions

FishAtlas may offer paid auto-renewable subscriptions through Apple. Current planned launch pricing may include an annual and monthly FishAtlas Pro plan. Prices, trial availability, features, and promotions are controlled by the applicable purchase screen and App Store configuration and may change prospectively.

Apple processes in-app subscription payments. Unless otherwise stated by Apple, an auto-renewable subscription renews until canceled through your Apple Account. Free trials convert to a paid subscription if not canceled before the trial ends. Refunds and billing issues for App Store transactions are subject to Apple’s policies.

11. Free and Pro features

Streams to Summits may determine which FishAtlas features are available on the free tier and which require FishAtlas Pro. Free access may include usage limits, previews, reduced map or Explore access, or other limitations. The full fish, fly, and bug guides, full Explore access, and other features may require Pro. Feature availability can change as the Service evolves.

12. Third-party services and data

FishAtlas uses or displays information from third parties, which may include Apple, Google/Firebase, mapping providers, government agencies, USGS, NOAA, weather providers, state agencies, species databases, and other public or licensed sources. Streams to Summits does not control independent third-party services and is not responsible for their availability, accuracy, terms, or privacy practices.

13. Safety and assumption of risk

Fishing, boating, wading, hiking, driving on remote roads, traveling near water, and outdoor recreation involve inherent risks including drowning, changing currents, cold water, unstable banks, weather, wildlife, terrain, isolation, property disputes, and equipment failure. You voluntarily assume the risks associated with your outdoor activities and remain responsible for your decisions, equipment, route, physical condition, and compliance with laws.

14. Intellectual property

FishAtlas, its software, design, branding, databases, original graphics, original photographs, text, algorithms, arrangement, and other proprietary material are owned by or licensed to Streams to Summits LLC and are protected by applicable intellectual-property laws. Government and third-party data remain subject to their respective ownership, licenses, and terms.

15. Beta and TestFlight versions

Beta versions may contain bugs, incomplete features, inaccurate data, crashes, or functionality that changes without notice. Beta access may be modified or discontinued at any time. You should not rely on a beta version for safety-critical or time-sensitive decisions.

16. Service changes and availability

We may add, remove, modify, suspend, or discontinue features or data sources. We do not guarantee uninterrupted availability. Maintenance, provider outages, network failures, API changes, or circumstances outside our control may limit the Service.

17. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” STREAMS TO SUMMITS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND RESULTS. NOTHING IN THESE TERMS EXCLUDES A WARRANTY THAT CANNOT LAWFULLY BE EXCLUDED.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMS TO SUMMITS LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR DAMAGES ARISING FROM RELIANCE ON FISHING, WEATHER, WATER, ACCESS, MAP, NAVIGATION, SPECIES, OR SAFETY INFORMATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF STREAMS TO SUMMITS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO STREAMS TO SUMMITS FOR FISHATLAS DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US $100. Some jurisdictions do not allow certain limitations, so some provisions may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Streams to Summits LLC from claims, losses, liabilities, and expenses arising from your unlawful use of the Service, violation of these Terms, violation of another person’s rights, or content you submit, except to the extent caused by Streams to Summits’ own conduct for which indemnification cannot lawfully be required.

20. Termination

You may stop using FishAtlas at any time. We may suspend or terminate access where reasonably necessary to protect the Service, users, third parties, or our legal rights, or for material violations of these Terms. Provisions that by their nature should survive termination will survive.

21. Governing law

Except where consumer-protection law requires otherwise, these Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles. Nothing in this section deprives a consumer of mandatory rights available under the laws of the consumer’s jurisdiction.

22. Apple-specific terms

If you obtained FishAtlas through Apple’s App Store, these Terms are between you and Streams to Summits, not Apple. Streams to Summits, not Apple, is responsible for FishAtlas and its content, maintenance and support, and product claims, except as otherwise required by law. Apple has no obligation to provide maintenance or support services for FishAtlas. To the extent required by Apple’s developer terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.

23. Changes to these Terms

We may update these Terms as FishAtlas changes. If a change materially affects your rights or obligations, we may provide notice and request renewed acceptance where appropriate. The effective date above identifies the current version.
